These rules may be picked up at Long Island Broadcasting, 760 Montauk Highway Water Mill, New York 11976, during regular business hours, which are Monday through Friday 9:00AM – 5:00PM.
All prizes must be picked up in person at P.O. Box 157 Water Mill, New York 11976. The person awarded the prize must claim prize within thirty (30) days of being declared winner or prize shall be forfeited. Any winner under sixteen (16) years of age must have parent or guardian claim prize on their behalf. All winners must provide photo identification, current mailing address, and social security number for each prize claimed. Winner is solely responsible for any and all applicable local, state, and federal taxes.
Eligibility and Limitations
Any individual awarded a prize within the past thirty (30) days on any Long Island Broadcasting radio station (BEACH 101.7, WEHM 92.9 & 96.9 and WBAZ 102.5FM), becomes ineligible, as do all members of the individual’s household, to claim additional prizes until at least the thirty-first (31st) day after winning the prize. This limitation applies regardless of whether the prize was actually claimed by the winner. Participants and winner(s) must reside within the Nassau/Suffolk New York metro area as defined by Arbitron and as determined by Long Island Broadcasting.
In contests or promotions where participants “qualify” for a certain “grand prize”, participants and/or residents of their household or immediate family may qualify one time only. Long Island Broadcasting reserves the right to refuse to award any prize to, or on behalf of, a minor. Employees of Long Island Broadcasting, a contest or promotion’s participating sponsors and their advertising agencies, employees of other Peoria metro area radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household.
Prize awarded is not transferable unless otherwise stated. Prize awarded “as is”.
By participating, all participants and winner(s) grant Long Island Broadcasting exclusive permission to use their name, character, photograph, voice, and likeness in connection with promotion of this and other contests. Further all participants and winner(s) waive any claim to royalty, right, or remuneration for such use both in present and in perpetuity.
For contests conducted via the Station’s website, Twitter.com, Instagram.com or Facebook.com page, the Station will select winners at random from participants who have made themselves part of said contest(s) by the methodology described by the Station, either on-air or online. For contests that determine a winner by selecting a certain number person to perform a requested action online, participants agree the computer or mobile device being used by Long Island Broadcasting to monitor the contest will provide official results and that these may vary from participant’s computer or mobile device. With all online contests, notification of winner will be made electronically and it is the sole responsibility of the contest participant to monitor the registered email, Twitter.com, Instagram.com or Facebook.com address for said notification. Long Island Broadcasting reserves the right to disqualify any individual or individuals for any acts deemed to gain an unfair advantage including, but not limited to, “scrolling”, “flooding”, or “spamming.” Unless specifically directed as part of the contesting methodology, multiple entries will not impact a participant’s chances as being selected a winner.
By participating, each participant and winner waives any and all claims of liability against Long Island Broadcasting, its employees and agents, for any personal injury or loss, which may occur from the conduct of, or participation in, the contest, or from the use of any prize.
Any valuation of the prize(s) stated above is based on available information provided to Long Island Broadcasting, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes. Each winner must provide Long Island Broadcasting with valid identification and a valid taxpayer identification number or social security number before any prize valued at $400 or more will be awarded. If the winner’s valid social security number or tax ID number is not provided, the prize will be forfeited. Prizes are not transferable or redeemable for cash unless otherwise stated. Any person winning over $600 in prizes from Long Island Broadcasting will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
Telephone and Delivery Disclaimer
Participants are restricted to the use of ordinary telephone equipment. Participants that enable the “Caller ID” block function will not be allowed to participate unless they enter their correct area code and telephone number. Long Island Broadcasting disclaims all liability for the inability of a participant to complete or continue a telephone call due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond Long Island Broadcasting’s control, or otherwise. Long Island Broadcasting disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method.
Long Island Broadcasting reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the contest, or obtained winner status using fraudulent means. Further, Long Island Broadcasting will resolve any disputes or ambiguities concerning the rules and Long Island Broadcasting’s decisions concerning such disputes shall be final. Long Island Broadcasting reserves the right to amend, modify or replace these rules at any time without notice. Verification this set of rules is currently in force is the sole responsibility of the participant. Verification may be accomplished by telephoning the office at 631-267-7800.
Each winner must submit proof of eligibility and sign an Long Island Broadcasting release to claim prize. No purchase necessary to participate or win. Void where prohibited. Odds of winning depend upon the number of participants. Long Island Broadcasting may substitute prizes of equivalent value, amend the rules or discontinue the contest at any time as announced on the station. Long Island Broadcasting disclaims any responsibility to notify participants of any aspect related to the conduct of this contest. Written copies of these rules are available during normal business hours at the business offices of the station and by mail from the station upon written request with a stamped, self-addressed return envelope. Entries must be handwritten, unless another form of entry is specifically authorized for the contest. No photocopying or mechanical reproduction of entry forms is permitted unless specifically authorized for the contest.
Compliance with Law
The conduct of this contest is governed by local and state law, which takes precedence over any rule to the contrary herein. Station shall follow the applicable local and state laws for conducting contests, including but not limited to notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, and providing specific written information about contest.
Real Band Battle Adendum
Bands must be available beginning at 4pm on day of the live band battle
If entire band submitted cannot attend they will forfeit their slot
WEHM management maintains the right to remove any band at any point during the contest
WEHM Management maintains the right to alter rules at any time.
WEHM Management maintains the right to use music and photo’s submitted in this contest at their discretion.
Votes will be open to the public during a designated period of time set by management. Listeners will get one vote, per day, during the voting period.
Five bands will proceed into the finals at the Real Band Balle Live, designated at a certain time by WEHM Management. Two or Three bands will be held in an alternate position should one of the Five finalists be disqualified or not be able to perform.
Live Band Battle rules. Five bands compete within a Ten minute time period. The band that gets the majority of five judge votes will win. There will be four celebrity judges in attendance that each get one vote. The fifth vote will be determined by the crowd voting on the winner. Whoever gets the majority of votes gets the 5th Judge vote.
